Westmark Development Company filed a development application for a condominiums on this site in 1991, but did not choose to build it until 2008. In the meantime, environmental laws had changed the density with which a developer could plan housing. Because of "vesting," wherein the developer needs only to follow land-use rules in effect at the time of developement application, Westmark could produce a far denser apartment complex than could be done had the project been filed in 2008. In this case, 200 units spread out in 7 buildings could be included on less than 10 acres. Later Burien city zoning would have limited Westmark to 3 units per acre.
